US Supreme Court Decision Strikes Down Trump Administration’s Use of IEEPA Tariffs
Today, February 20th, the Supreme Court ruled that President Donald Trump does not have authority under the International Emergency Economic Powers Act (IEEPA) to impose tariffs. In a 6–3 decision, the Court held that while the statute permits the president to “regulate … importation” in response to an unusual or extraordinary threat, it does not grant the power to set tariffs.
Chief Justice John Roberts, writing for the majority on the statutory interpretation issue, explained that if Congress had intended to delegate tariff authority under IEEPA, it would have done so explicitly, as it has in other tariff laws.
The Court affirmed the ruling of the U.S. Court of Appeals for the Federal Circuit and remanded the case to the U.S. Court of International Trade to determine whether the lower court may issue a nationwide injunction against tariffs imposed pursuant to IEEPA.
