President Trump to Impose Tariffs on Countries Providing Oil to Cuba

Yesterday evening, January 29th, President Trump issued an Executive Order stating an additional ad valorem duty may be imposed on goods imported into the US which are products of a country that directly or indirectly sells or otherwise provides any oil to Cuba , effective at 12:01 AM EST on January 30th, 2026.

The president cited IEEPA for his reason to impose the tariff, adding that Cuba imposes a national security risk to the US.

The exact tariff amounts have not yet been announced by the administration. However, the EO authorizes the secretaries of State and Commerce to “take all necessary actions, including issuing rules and guidance, to implement the tariff system and related measures.”  The Executive Order also said the Commerce Secretary must determine if any country is making such sales after January 30th, and that “the Secretary of State, in consultation with the Secretary of the Treasury, the Secretary of Commerce, the Secretary of Homeland Security, and the United States Trade Representative, shall determine whether and to what extent an additional ad valorem rate of duty should be imposed on goods that are products of the foreign country.”

The EO fact sheet said the president may modify the tariff conditions if Cuba or affected countries “take significant steps to address the threat or align with US national security and foreign policy objectives.”

In addition, the president warned in the EO that, “should a foreign country retaliate against the United States in response to this order or any action taken pursuant to this order, I may modify this order or actions taken pursuant to this order to ensure the efficacy of this order and the actions taken pursuant to this order to deal with the national emergency declared in this order.”
