Today, we have a subsequent update on the Section 301 List 3 Tariff increases. US Customs issued a CSMS message, “CSMS #19-000238.”
This message refers to most of the Federal Register notices that have been issued throughout the history of List 3. An important note is that the list of items that were removed from List 3 on September 28, 2018 are now back on it with the 25% duty rate (i.e. items such as Bluetooth and some infant furniture products).
The following is a critical paragraph from the CSMS message:
“For subject goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern standard time on May 10, 2019, and before June 1, 2019, and exported to the United States before May 10, 2019, report the following HTS number and duty rate:
Duty Rate: 10 percent”
The way we believe is accurate to interpret this statement is as the following: for shipments that left China prior to May 10, 2019, and are entered into the US prior to June 1, 2019 (by May 31, 2019), the 10% rate will apply.
