The Office of the U.S. Trade Representative (USTR) announced on the evening of July 23rd that it will proceed with imposing Section 301 tariffs on products from 60 countries ranging from 10% to 12.5%.
The U.S. will impose 10% tariffs on most goods from Argentina, Bangladesh, Cambodia, Canada, Ecuador, El Salvador, Guatemala, Honduras, India, Indonesia, Jordan, Malaysia, Mexico, Pakistan, Sri Lanka, the U.K, and Trinidad and Tobago, it will also impose a combination of MFN and Section 301 duty to reach a flat 10% rate on goods from the EU and Taiwan and will further impose a combination of MFN and Section 301 duty to reach a flat rate of 12.5% on goods from Japan, South Korea and Switzerland.
USTR said the Section 301 tariffs become effective with respect to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 AM EDT on Friday, July 24th, except that goods loaded onto a vessel (ocean shipments) at the port of loading and in transit on the final mode of transit before 12:01 AM EDT on July 24th and entered for consumption or withdrawn from warehouse for consumption before 12:01 AM EDT on July 28th shall not be subject to such additional duty. Please note, this does not apply to air, truck, or rail shipments.
U.S. Trade Representative Jamieson Greer said the USTR took final action, at the direction of President Trump, in the USTR’s Section 301 Investigations into the Acts, Policies, and Practices of Various Economies Related to the Failure to Impose and Effectively Enforce a Prohibition on the Importation of Goods Produced with Forced Labor.
“Trading partners that have made commitments to adopt, and effectively enforce, forced labor import prohibitions will have a 10% tariff, and trading partners that have failed to adopt a forced labor import prohibition will have a 12.5% tariff rate,” USTR said in a statement.
The imported products which are impacted by these Section 301 tariffs and related HTS numbers, as well as those products which are exempt, are listed in this Federal Register notice.
