Requesters must first register on the USTR Exclusions Portal.\u00a0 After registration, the requester can fill out and submit one or more exclusion request forms. The Guidelines are available on the USTR website under \u201cEnforcement\/Section 301 Investigations.\u201d Interested persons may also visit www.cbp.gov\/trade\/rulings for instructions on filing a ruling letter and guidance on product identification.<\/p>\n Q: What should requestors address with regard to the rationale for the requested <\/strong>exclusion?<\/strong><\/p>\n A: Requestors must address all of the following:<\/p>\n Q: Can interested persons request exclusion for multiple products in a single exclusion <\/strong>request?<\/strong><\/p>\n A: No. Interested persons seeking to exclude two or more products must submit a separate request for each product, i.e., one product per request.<\/p>\n Q: What is a single product?<\/strong><\/p>\n A: A single product may include two or more goods with similar product characteristics or attributes. Goods with different SKUs, model numbers, or sizes are not necessarily different Q: Will there be another hearing?<\/strong><\/p>\n A: No. USTR will not hold hearings in connection with the exclusion requests for the $200 billion trade action.<\/p>\n Q: After submitting a request for a product exclusion, will interested persons have an <\/strong>opportunity to comment on the request?<\/strong><\/p>\n A: Yes. After a request for exclusion of a particular product is posted on USTR\u2019s online portal, interested persons will have 14 days to respond to the request, indicating support or opposition Q: Will interested persons have an opportunity to reply to responses?<\/strong><\/p>\n A: Yes. Replies to responses will be publicly available.<\/p>\n Q: How soon will exclusion determinations be made after I submit my request through the <\/strong>USTR Exclusions Portal?<\/strong><\/p>\n A: USTR will evaluate each request on a case-by-case basis and will periodically announce decisions on pending requests.<\/p>\n Q: How do I track the status of my exclusion request?<\/strong><\/p>\n A: The index on the USTR Exclusions Portal will indicate the status of each request in the review process.<\/p>\n Q: How will USTR announce its decision on which exclusion requests to grant or deny?<\/strong><\/p>\n A: USTR will be reviewing all requests for exclusion as they are received. USTR will email decision letters to requesters when a decision has been made, and the decision letters will be posted on the USTR Exclusions Portal.<\/p>\n Q: If my exclusion request is granted, when and for how long will the exclusion be <\/strong>effective?<\/strong><\/p>\n A: Any exclusion will be effective starting from the September 24, 2018 effective date of the additional duties, and extending for one year after the publication of the exclusion determination in the Federal Register. If Q: How can an interested person know which products are being reviewed for exclusion?<\/strong><\/p>\n A: Interested persons can view all exclusion requests on the Public Docket of the USTR Exclusions Portal. Similarly, the notice requests information on whether the product is available from U.S. or third country sources. If some models are available from non-Chinese sources, and other models are not, this would weigh against including those models in a single request.<\/p>\n
