USTR Extends All Section 301 Exclusions Through End of Year

The Office of the United States Trade Representative (USTR) announced yesterday afternoon that they plan to further extend the 352 reinstated exclusions and 77 COVID-related exclusions in the China Section 301 Investigation until December 31st, 2023. The exclusions were previously scheduled to expire on September 30th, 2023. The extension will allow for further consideration under the statutory four-year review. 

The list of all 352 reinstated exclusions in the USTR Notice is organized into four groups based on the “list” under which the particular tariffs were originally imposed:  List 1, List 2, List 3 or List 4A.  This is for unliquidated entries going back to October 12th, 2021. 

The reinstated exclusions are available for any product that meets the description in the product exclusion. In particular, the scope of each exclusion is governed by the scope of the ten-digit Harmonized Tariff Schedule of the United States (HTSUS) statistical reporting numbers and product descriptions in note 20(ttt) to subchapter III of chapter 99 of the HTSUS.
