UPDATE CIT Orders CBP to Begin Automatic Refunds of IEEPA Duties
The following is an update to our March 5th Customer Advisory, CIT Orders CBP to Begin Automatic Refunds of IEEPA Duties:
We have received further clarification in regards to liquidated entries that are within the 90-day voluntary reliquidation window.
If you have entries that are beyond the 90-day CBP reliquidation window that are subject to the additional IEEPA tariffs, you may wish to consider filing protests to preserve potential refund rights, but if all your entries are unliquidated or well-within the 90-day CBP reliquidation window, then you may wish to wait until the CBP administrative process Consolidated Administration and Processing of Entries (CAPE) is operational in ACE. Our Customer Advisory with further information on CAPE may be found here.
For example, entries liquidating on March 1st, CBP has 90 days from this date to reliquidate the entry. If CBP has not flagged the entry for re-liquidation within this 90-day window, we would encourage the Importer to file Protest to protect the interest under the IEEPA refund process.
RIM encourages all importers to assess their individual circumstances and select the course of action that most appropriately aligns with their organization’s risk tolerance and business objectives. If you are unsure of the best course of action for your company, we suggest reaching out to a trade attorney for further guidance.
Further, we strongly advise all customers who have not already done so to establish an ACE Portal account and an ACH refund account with CBP.
If you do not already have an ACE portal account, you can use the link below to sign up. The step-by-step directions can be found here.
ACE ACH instructions can be found here.
RIM logistics, ltd. will continue to closely monitor this evolving situation and provide updates as necessary. Please reach out to your RIM representative if you have any further questions or need assistance with ACE/ACH.
