UPDATE CIT Finds Trump Unlawfully Used Section 122 Balance-of-Payments Tariff Authority
The below is an update to our earlier customer advisory, CIT Finds Trump Unlawfully Used Section 122 Balance-of-Payments Tariff Authority:
The United States has filed a pair of notices challenging the Court of International Trade’s May 7th ruling on Section 122 tariffs, which found that Donald Trump unlawfully invoked Section 122 of the Trade Act of 1974 to impose a 10% global tariff.
The court also issued a permanent injunction prohibiting the collection of these tariffs, though it applies only to the plaintiffs Burlap & Barrel, Basic Fun!, and the Washington State as the direct importers that brought the case. The United States Court of International Trade specified that the injunction will not take effect for five (5) days.
