Guidance – [Updated 4PM CST] Modifying Reciprocal Tariff Rate for China
RIM has received additional information, and it is our understanding that, unfortunately, the lower tariff can only be applied to shipments with an Immediate Transportation (IT) date of today, May 14, 2025, or later. We cannot resubmit entries with the lower duty rate for any shipments that have already been cleared by U.S. Customs.
If a shipment does not require an IT to be issued, the date the shipment arrives in the U.S. will determine the applicable tariff rate. However, if you have goods in transit that have not yet cleared Customs, and the IT was issued prior to today, you will be subject to the higher tariff.
Code of Federal Regulations 141.69
Merchandise covered by an Immediate Transportation (IT) entry at the original port of importation—if not subject to quantitative or tariff-rate quotas and entered for consumption at the designated port—is subject to the duty rates in effect at the time the IT entry was accepted at the original port. This means the duty rate is determined by the regulations in place when the IT entry was filed, not when the goods are entered for consumption at their final destination.
